WHEN YOU ARE AGREEING TO THE PURCHASE OF A SERIALIED ITEM AT CROSSHAIRS TEXAS, YOU ARE AGREEING TO THE TERM BELOW:

This is a receipt that Crosshairs Texas has started the required background check through the National Instant Criminal Background Check System (NICS). It ensures you are eligible to purchase a firearm.

Crosshairs Texas is waiting for one of five possible dispositions:

_______RESEARCHING_______PROCEED

_______DELAY_______OPEN_______DENIED

A DELAY response indicates that information you supplied on the ATF Form 4473 has been matched with information contained in the National Crime Information Center, the Interstate Identification Index, and/or the NICS Indices.  Possibly the subject of the background check has been matched with either a state or federal potentially prohibiting record containing a similar name and/or similar descriptive features (name, sex, race, date of birth, state of residence, social security number, height, weight, or place of birth).

A “DELAYED” message means the FBI needs to do additional research to verify the person’s background. Their staff works closely with federal, state, local, and tribal law enforcement agencies and courts to verify eligibility. In some cases, this can be a time-consuming process.

If the FBI cannot make a determination within three business days of a background check, the FFL may transfer the firearm, unless prohibited by state law (per the Brady Handgun Violence Prevention Act of 1993.)

“OPEN”status (after 3 business days): Under federal law, the FBI has three business days to approve or deny a NICS check. If a final determination isn’t made within this period, the status may change to “OPEN”, an OPEN status indicates a delayed background check.

_______I will be the owner of the listed item(s), pending completion of ATF requirements

Per ATF authority, CHT maintains the right to deny any sale, service, and/or transfer for any reason.

I meet all ATF requirements as to the purchase, ownership, and possession of the above listed item(s).

I possess the valid identification requirements specified by the state, federal, and CHT.

I am not committing a STRAW PURCHASE.

If I receive a NICS or any other DENIAL, my options are:

_______I am responsible for acquiring a return shipping label, a Return Authorization Number (RMA), and will be charged $159.98 (non-NFA item) or $199.99 (NFA item) to have CHT return the item for me.

DENIAL/FAILED background check:

There will be a 40% restocking fee for all controlled items returned due to a failed background check or a denied underage purchase after the Appeal Process.

_______I can pay storage fees of $50 per month while going through the Appeal Process.

The purchaser acknowledges and agrees to abide by all federal, state, and local regulations regarding the ownership and use of this firearm.

Prospective firearms buyers who receive a “DENIED” status on their background checks may have a state or federal firearm prohibition. The denied individual may choose to pursue a challenge and/or apply to the Voluntary Appeal File.

DENIAL/FAILED background check:

There will be a 40% restocking fee for all controlled items returned due to a failed background check or a denied underage purchase.
