1. AGREEMENT TO TERMS
These Terms of Use (“Terms”) constitute a legally binding agreement between you and Crosshairs Texas, LLC (“Company,” “we,” “us,” or “our”) governing your access to and use of our website, services, products, and shooting range facilities. By accessing our website, making a purchase, or using our range facilities, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of our website and services.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING LIMITATIONS ON LIABILITY, A DISPUTE RESOLUTION PROVISION, AND AN ASSUMPTION OF RISK ACKNOWLEDGMENT.
2. AGE AND ELIGIBILITY REQUIREMENTS
2.1 Minimum Age Requirement
You must be at least eighteen (18) years of age to access and use this website and our services. By using this website or our services, you represent and warrant that you are at least eighteen (18) years of age. If you are under eighteen years of age, you are prohibited from using this website or providing any personal information.
2.2 Firearms Purchase Eligibility
The purchase of firearms is subject to federal, state, and local laws and regulations. Under federal law, you must be at least eighteen (18) years of age to purchase a rifle or shotgun and at least twenty-one (21) years of age to purchase a handgun from a federally licensed firearms dealer. Additionally, you must not be a prohibited person under 18 U.S.C. § 922(g), which includes, but is not limited to: persons convicted of a crime punishable by imprisonment for more than one year; fugitives from justice; unlawful users of or persons addicted to controlled substances; persons adjudicated as mentally defective or committed to a mental institution; illegal aliens; persons dishonorably discharged from the Armed Forces; persons who have renounced United States citizenship; persons subject to certain court orders; and persons convicted of misdemeanor crimes of domestic violence.
2.3 Texas State Requirements
In addition to federal requirements, all firearms transactions must comply with applicable Texas state law. By making a purchase, you represent and warrant that you are legally permitted to purchase, possess, and own firearms under all applicable federal, state, and local laws.
3. FIREARMS TRANSACTIONS
3.1 Background Check Requirement
All firearms sales are subject to a background check through the National Instant Criminal Background Check System (NICS) as required by federal law. You will be required to complete ATF Form 4473 (Firearms Transaction Record) and provide valid government-issued identification. A firearms transfer will not be completed if the background check results in a “denied” or “delayed” response, or if you fail to provide accurate and complete information on the required forms.
3.2 False Statements
Making false statements or providing false information on ATF Form 4473 is a federal felony punishable by up to ten (10) years imprisonment and/or a fine of up to $250,000. This includes, but is not limited to, providing false information about your identity, eligibility to purchase firearms, or the actual buyer of the firearm (straw purchase).
3.3 Straw Purchases Prohibited
It is a federal crime to purchase a firearm on behalf of another person (a “straw purchase”). All purchasers must be the actual buyer of the firearm. You may not purchase a firearm on behalf of another person, even if that person is legally eligible to purchase firearms.
3.4 Transfer Completion
All firearms must be picked up in person at our physical location at 1102 College St., Bastrop, TX 78602. We do not ship firearms directly to customers. If you order a firearm online or arrange for a transfer, you must complete all required paperwork and pass a background check at the time of pickup before the firearm will be released to you.
4. AMMUNITION SALES
The sale of ammunition is subject to federal and state law. You must be at least eighteen (18) years of age to purchase rifle or shotgun ammunition and at least twenty-one (21) years of age to purchase handgun ammunition. By purchasing ammunition, you represent and warrant that you are of legal age and are not prohibited from possessing ammunition under federal, state, or local law.
5. SHOOTING RANGE RULES AND POLICIES
5.1 Range Safety Rules
Use of our shooting range facilities is subject to strict compliance with all posted range rules and safety procedures. All range users must: treat all firearms as if they are loaded at all times; keep firearms pointed in a safe direction at all times; keep your finger off the trigger until ready to shoot; be certain of your target and what is beyond it; wear appropriate eye and ear protection at all times while on the range; follow all commands from range safety officers immediately and without question; never handle firearms behind the firing line; cease fire immediately when commanded; and report any unsafe conditions or behavior to range staff immediately.
5.2 Prohibited Conduct
The following conduct is strictly prohibited on our premises and will result in immediate removal and potential permanent ban from our facilities: possession or consumption of alcohol or controlled substances; use of firearms while under the influence of alcohol, drugs, or medication that may impair judgment or motor skills; drawing from a holster unless specifically authorized for a training course; rapid fire or “mag dumps” unless specifically authorized; shooting at anything other than approved targets; bringing loaded firearms into the retail area; unsafe gun handling of any kind; harassment, threatening behavior, or intimidation of staff or other customers; and violation of any posted rules or directions from staff.
5.3 Waiver and Release Requirement
All range users will be required to execute a separate Range Safety Waiver and Release of Liability form before being permitted to use the range facilities. The waiver must be signed by all participants and, for minors accompanied by a legal guardian, must be signed by the legal guardian.
5.4 Supervision of Minors
Persons under eighteen (18) years of age may only use the range facilities when directly supervised at all times by a parent or legal guardian who assumes full responsibility for the minor’s actions. The supervising adult must remain within arm’s reach of the minor at all times while firearms are being handled. Certain additional restrictions may apply based on the minor’s age and experience level, at the sole discretion of Crosshairs Texas, LLC.
6. ASSUMPTION OF RISK
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE USE OF FIREARMS AND SHOOTING RANGE FACILITIES INVOLVES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO: RISK OF INJURY OR DEATH FROM DISCHARGE OF FIREARMS; EXPOSURE TO LOUD NOISES THAT MAY CAUSE HEARING DAMAGE; EXPOSURE TO LEAD AND OTHER HAZARDOUS MATERIALS; RISK OF INJURY FROM RICOCHETS, BULLET FRAGMENTS, OR EJECTED SHELL CASINGS; AND RISK OF INJURY FROM EQUIPMENT MALFUNCTION OR DEFECT.
BY USING OUR RANGE FACILITIES, YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM OR RELATED TO YOUR USE OF THE FACILITIES, WHETHER CAUSED BY YOUR NEGLIGENCE, THE NEGLIGENCE OF OTHERS, OR OTHERWISE. YOU AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY AND THE SAFETY OF ANY MINORS UNDER YOUR SUPERVISION.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CROSSHAIRS TEXAS, LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE, SERVICES, OR FACILITIES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF CROSSHAIRS TEXAS, LLC FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR WEBSITE, SERVICES, OR FACILITIES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
8. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Crosshairs Texas, LLC, its members, managers, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from: your use of our website, services, or facilities; your violation of these Terms; your violation of any applicable law, rule, or regulation; your violation of any rights of a third party; any false or inaccurate information you provide; and your negligent or wrongful conduct.
9. INTELLECTUAL PROPERTY
All content on this website, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Crosshairs Texas, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.
10. USER CONDUCT
You agree not to use our website or services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. You agree not to attempt to gain unauthorized access to any part of our website, other accounts, computer systems, or networks connected to our servers. You agree not to use any robot, spider, scraper, or other automated means to access our website without our express written permission.
11. RETURNS AND REFUNDS
Due to the nature of our products and federal regulations governing firearms sales, all sales of firearms are final once the background check has been initiated. Non-firearm merchandise may be returned within thirty (30) days of purchase in unused, original condition with receipt for store credit or exchange. Ammunition is non-returnable for safety reasons. Special orders and custom work are non-refundable. Defective products will be handled in accordance with the manufacturer’s warranty policy.
12. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or your use of our website or services shall be brought exclusively in the state or federal courts located in Bastrop County, Texas, and you consent to the personal jurisdiction of such courts.
13. DISPUTE RESOLUTION
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of our website, services, or facilities shall first be submitted to mediation in accordance with the mediation rules of the American Arbitration Association. If the dispute is not resolved through mediation within sixty (60) days, either party may initiate litigation in accordance with Section 12 above. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
14. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the intent of the parties, or if such modification is not possible, shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
15. WAIVER
The failure of Crosshairs Texas, LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Crosshairs Texas, LLC.
16. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Crosshairs Texas, LLC concerning your use of our website and services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
17. CHANGES TO TERMS
We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes to these Terms, we will notify you by posting the revised Terms on our website and updating the “Effective Date” at the top of these Terms. Your continued use of our website or services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must discontinue using our website and services.
