Jensen v. ATF Has Changed the Legal Landscape

A federal district court decision in Jensen v. ATF has created significant changes affecting enforcement of certain National Firearms Act requirements for qualifying parties.

Crosshairs Texas has adopted a Temporary Compliance Guidance & Operating Policy to address transactions potentially covered by the decision.

The ruling may affect qualifying transactions involving:

WHAT IS AN NFA FIREARM?

The National Firearms Act, commonly called the NFA, regulates certain categories of firearms and devices.

NFA firearms include:

Commonly called silencers, suppressors are designed to reduce the sound signature and muzzle blast produced when a firearm is discharged.

🎯 SHORT-BARRELED RIFLES

Generally, rifles meeting the federal statutory definition of a short-barreled rifle, including certain rifles with barrels under 16 inches.

🔹 SHORT-BARRELED SHOTGUNS

Generally, shotguns meeting the federal statutory definition of a short-barreled shotgun, including certain shotguns with barrels under 18 inches.

⚙ MACHINE GUNS

Fully automatic firearms capable of firing more than one round through a single function of the trigger, as defined by federal law.

🔸 ANY OTHER WEAPONS

Certain firearms and devices classified under the NFA as Any Other Weapons, commonly abbreviated AOW.

The ATF Form 4 is commonly used when an existing NFA firearm is transferred from a dealer to an individual or qualifying legal entity.

ATF processing times vary.

WHAT ABOUT TEXAS-MADE SUPPRESSORS?

Texas enacted legislation addressing suppressors manufactured in Texas from qualifying materials and remaining within Texas.

That Texas statute and the federal Jensen v. ATF litigation involve different legal theories and should not be treated as interchangeable.

A Texas statute does not, by itself, mean every suppressor manufactured or possessed in Texas is automatically exempt from every federal requirement.

Certain machine guns may lawfully be possessed by eligible civilians when the firearm is lawfully transferable under federal law and all other requirements are satisfied.

Civilian-transferable machine guns are limited by federal law, which makes them substantially different from ordinary suppressor purchases.

NFA STORAGE & CUSTOMER RESPONSIBILITIES

Once an NFA firearm arrives at Crosshairs Texas, customers are responsible for completing required paperwork within the timelines established by our store policy.

Crosshairs Texas may assess storage fees for NFA firearms that remain in our possession for extended periods.

Items left without communication may eventually become subject to Crosshairs Texas abandoned-property procedures.
